It depends where you are. In Canada, mineral and oil rights are not included in fee simple title. I doubt if the state can claim your land, but I bet they can claim oil and maybe even water--provided they compensate you for access and so on. No they cannot unless they specificly have a state law saying so,the oil and mineral rights belong to the owner of the property.
